Summary:
Landlords can still give notice on fault grounds (s.8 HA 1988) or notice only (s. 21 HA 1988). However, in all cases and for all grounds the notice period is 3 months.
There is no prohibition on issuing possession proceedings. However, the claim will be stayed and not listed for hearing until the current situation improves. Landlords won’t obtain an enforceable possession order for at least 23 August 2020.
For Landlords, the best way forward in many cases will be to get notices issued and possession claims started. Landlords will then be towards the front of the queue to evict problem tenants when the situation improves.
There is going to be a huge back log of cases. Furthermore, it appears that there will be a new “Pre-Action Protocol” for private sector possession claims. This will mean additional stages to be completed before a possession order can be pursued.
Issuing claims now may avoid a lot of delay and having to jump through additional hoops.
